Extranjería requerimiento: sworn translation in your 10 working days

Got a requerimiento from Extranjería? We deliver a sworn translation into Spanish (traducción jurada) of every document your notice names, signed by a MAEC-appointed translator. It is for residents answering a correction notice on arraigo, reunification, renewal or nationality files. Nationality notices follow RD 1004/2015, art. 10, which allows three months, not 10 working days. Certificates of 1–2 pages come back the same day where the document allows, from €29 plus 60%. Upload the notice for a quote.

What is a requerimiento de subsanación?

A requerimiento de subsanación is a correction notice from a Spanish office, such as an Oficina de Extranjería. It says your application lacks a document or has a defect. It is also called a requerimiento de documentación, and the fix is a subsanación de documentos. Under Ley 39/2015, article 68, you must fix it within 10 working days (días hábiles), or the application is treated as withdrawn.

The notice usually lists each missing or defective item. When translation is the issue, it may ask for a sworn translation, or for the apostille to be translated too.

Read the list closely. Some items need a new document from your country first, such as a fresh criminal record. Others need only a sworn translation of a document you already hold.

How many days do I have to answer a requerimiento?

You have 10 working days (días hábiles) to answer a requerimiento de subsanación from Extranjería, under Ley 39/2015, article 68.1. Article 30 of the same law counts only working days. Nationality files are different: RD 1004/2015, article 10, gives three months. Saturdays, Sundays and public holidays do not count, and day 1 is the day after you are notified.

Worked example. You are notified on Tuesday 10 November 2026. Day 1 is Wednesday 11 November. If no public holiday falls in between, day 10 is Tuesday 24 November 2026.

  • Electronic notices. The count starts the day after you open the notice. An electronic notice left unopened for 10 calendar days counts as notified anyway (Ley 39/2015, art. 43.2).
  • Local holidays. Regional and local holidays can move the date. If in doubt, ask the office or your adviser.

Sources: Ley 39/2015, articles 30, 43 and 68, BOE · Mercurio, sede.administracionespublicas.gob.es · Hoja informativa 61. Last checked: 1 October 2026.

Can the deadline be extended?

Yes, in some cases. Ley 39/2015, article 68.2, lets the office extend the 10 working days by up to 5 more days. This applies when providing the documents is especially difficult, outside selective or competitive procedures. You can ask, or the office can grant it itself.

Ask for the extension before the 10 working days end, not after. Whether to ask is your decision or your adviser's.

What happens if I miss the requerimiento deadline?

If you do not answer within 10 working days, Ley 39/2015, article 68.1, says the application is treated as withdrawn (desistido). Treat the last working day as fixed, and plan your sworn translation well inside it. Sending us the notice on the day it arrives leaves the most time.

What follows a withdrawn application depends on your procedure. A lawyer or the office can tell you your options. We do not advise on that.

What we can do is take the translation off the critical path. Very short deadlines suit our same-day and 24-hour sworn translation service.

How do I answer a requerimiento that asks for a translation?

To answer a requerimiento that asks for a translation, use a MAEC-appointed sworn translator. That is the first route Extranjería's Hoja informativa 61 lists. Translate the document and its apostille together. Then file the reply, with the translation attached, through the channel your notice states, before working day 10 ends.

In practice, when the issue is a translation:

  1. Upload the notice to us. We read which documents and which defect it names.
  2. Add the apostille if missing. Apostille or legalise first, then translate both together. See why the apostille goes on before the translation, or our apostille and sworn translation service.
  3. Approve the draft. You confirm names, dates and places before the seal is applied.
  4. File the signed PDF. You, or your representative, file the reply with the translation attached.

A digitally signed sworn translation has been legally valid since 8 March 2025 (Orden AUC/213/2025). Detail: digital sworn translation in Spain.

Getting a home-country criminal record while living in Spain

A requerimiento often asks for a criminal record you do not yet have. Getting it is the slow step, so start that first, then send us the apostilled scan.

  • India: Police Clearance Certificate (PCC), then MEA apostille. See Indian documents for Spain.
  • Pakistan: police character certificate, requested from Spain through the Embassy of Pakistan in Madrid, then MOFA apostille. See Pakistani documents for Spain.
  • Morocco: fiche anthropométrique, requested online through the DGSN e-police portal and collected at a centre, then apostille. See Moroccan documents for Spain.

Your country's consulate in Spain, or a relative with a power of attorney at home, may also help. Check with the issuing authority first. If the certificate cannot arrive in time, ask for the extra days before working day 10.

Checks before your requerimiento reply is filed

  • Every document and defect named in the notice is covered.
  • The apostille or legalisation is present and translated with the document.
  • Every name matches your passport. Where spellings differ, the translator adds a note.
  • Every page, including backs and stamps, is translated and sealed.

Frequently asked questions

How do I upload the translation through Mercurio?

Mercurio is the online platform on sede.administracionespublicas.gob.es, and it needs a digital certificate. Representatives such as lawyers use it too. Once your file is recorded, further documents, including replies to a requerimiento, are added there. Attach our signed PDF to your reply. Nationality requerimientos are answered through the Ministry of Justice sede electrónica instead.

Can you translate the requerimiento letter itself into English?

We translate into Spanish only. We can tell you which documents the notice names and what translation it asks for. For the wording of your reply (contestación), speak to a lawyer, a gestoría or the office.

What if the requerimiento names a document I do not have yet?

Start obtaining it at once from the issuing country, with its apostille or legalisation. If it is especially hard to get in time, ask for the extra days before working day 10. We translate it as soon as the apostille is on.
